1. Acceptance of Terms

Welcome to GO Loop Leasing, LLC, GO Loop LLC and related entities (collectively “GOL,” “we,” “us,” or “our”). By accessing or using our websites, apps, products or services (the “Services”), you agree to be bound by these Terms and our Privacy Policy. Additional policies or conditions applicable to specific Services (collectively, “Additional Terms”) are incorporated by reference. If you do not agree with any part of these Terms or Additional Terms, you must refrain from using the Services.

2. Changes to Terms

We may update these Terms at any time to reflect changes in our Services or legal requirements. If we do, we’ll notify you via our website, email, or another method. Your continued use after the update becomes effective signifies acceptance. If you disagree, you must stop using the Services.

3. Privacy & Children

Your privacy is important to us. Please review our Privacy Policy for details.
COPPA Compliance: We do not knowingly collect personal data from children under 13. If you suspect we have collected info from a child under 13, please contact us at help@letsgoloop.com.

4. Account Registration

To use certain features, you may need to register, choose a password and GOL User ID, and provide accurate, current information. You’re responsible for maintaining the confidentiality of your account. You agree:

  • You’re of legal age or have parental consent.
  • To comply with applicable laws.
  • Not to transfer, impersonate, or share your account without our permission.

If you use the Services on behalf of an organization, you represent having authority to bind that entity.

5. Service Facilitation

Our platform connects users (e.g., ride-share drivers, delivery providers) with vehicle rentals for ride-share and delivery customers. We do not provide transportation, freight, or delivery services ourselves. GOL is not a carrier and has no liability for Services performed between users.

Drivers and providers are independent contractors—not employees, agents, or franchisees—and GOL does not supervise such Services. GOL disclaims all warranties and liability for third-party service quality or compliance.

No side agreements outside the platform are permitted. Violations may result in account termination.

6. Communications

By providing contact details, you consent to receive transactional and marketing messages (e.g., email, SMS). Message and data rates may apply; consult your carrier for applicable charges. You may opt out per message instructions.

7. Acceptable Use

You agree not to use the Services to:

  1. Steal, infringe or violate intellectual property or legal rights.
  2. Break any law or regulation.
  3. Transmit harmful, fraudulent, harassing, or obscene content.
  4. Compromise the security of your account or another account.
  5. Access data by illicit means.
  6. Spam, scrape, reverse-engineer, or overburden our systems.

Violating these rules may result in suspension or termination.

8. Our and Your Rights to Content

8.1. GOL Content License
All content provided by GOL (“Content”) is protected. You are granted a limited, non-exclusive license to use it as intended; other uses are prohibited without permission.

8.2. Your Contributions
Anything you contribute (“User Submissions”) must be lawful and not infringe others’ rights. You grant GOL—and other users when applicable—a perpetual, worldwide, royalty free license to use, reproduce, modify, and distribute these Submissions for the purpose of operating and promoting the Services.

GOL may also adapt Submissions as needed for technical compatibility.

9. Disclaimers & Limitations of Liability

Warranty Disclaimer: The Services are provided “as-is.” GOL and affiliates make no warranties, express or implied.

Limitation of Liability: To the maximum extent allowed, GOL and its affiliates will not be liable for (a) indirect, incidental, or consequential damages, (b) third-party costs, or (c) more than the greater of $100 or the amount you paid us in the past 12 months. Some jurisdictions may not allow for these limitations.

Indemnification: You agree to indemnify GOL for claims arising from your use of the Services, your violation of these Terms, or (for delivery providers) any losses related to delivery services.

Release of Third Party Claims: Any disputes with other users or third parties are between you and them; GOL is not liable.

10. Background Checks

GOL may conduct background checks using third parties. You authorize the sharing of your information for such purposes and may be responsible for any fees or disclosures required.

11. Termination & Survival

GOL may terminate or suspend your access for any reason, with or without notice.
You may deactivate your account at any time by submitting a request to help@letsgoloop.com.

Surviving provisions after termination include payment of obligations, intellectual property rights, indemnification, warranties, limitations of liability, dispute resolution, and any terms meant to survive based on their nature.

12. Modifications to Services

GOL reserves the right to modify or discontinue any feature or aspect of the Services at its sole discretion without notice.

13. Mobile App & App Stores

Use of our mobile app is governed both by these Terms and by the policies of the App Store (Apple) or Android store. Where conflicts exist, the stricter terms apply. You acknowledge:

  • We are not responsible for app maintenance—App Store support is your recourse.
  • Apple/Android are third-party beneficiaries of relevant sections of these Terms.

14. Governing Law & Disputes

Choice of Law: These Terms are governed by Massachusetts law and the Federal Arbitration Act, without regard to conflict-of-law rules.

Arbitration Agreement: Most disputes will be resolved by individual, binding arbitration in Middlesex County, Massachusetts, under JAMS rules.

  • GOL will cover arbitration fees for claims under $75,000.
  • You may still file in small claims court or seek injunctive relief.
  • You and GOL both waive jury trials and class actions—disputes must be individual.
  • To opt out of arbitration, send written notice (name, contact info, opt‑out statement) within 30 days of first agreeing to these Terms.
  • If you opt out or arbitration is unenforceable, disputes will be heard exclusively in courts in Middlesex County, Massachusetts.

Severability: If you opt out or certain terms are invalidated, the remaining arbitration provisions will be void. Other parts of these Terms will still apply.

15. Miscellaneous

  • Assignment: You may not transfer these Terms or your account. GOL may assign its rights freely.
  • Taxes: You are responsible for all taxes and duties related to your use.
  • Waiver: Failure by either party to enforce a right is not a waiver.
  • Entire Agreement: These Terms (plus Privacy and Additional Terms) form the complete agreement and supersede prior communications.
  • No Employment Relationship: You acknowledge you are not a GOL employee or agent, and you have no authority to bind GOL.

Acceptance

By using or registering for GOL’s Services, you acknowledge that you have read and agree to these Terms as of the date/time when you accepted or first used the Services.
